IRB hearings

Refugee Protection Division, Refugee Appeal Division, Immigration Division and Immigration Appeal Division.

The Immigration and Refugee Board of Canada (IRB) is an independent tribunal with four divisions. Each division deals with a different type of immigration or refugee matter.

Preparation starts with identifying the division, the decision or issue involved, and the applicable process. A refugee claim, an appeal and a detention review are separate proceedings with different requirements.

What this service covers

Refugee Protection Division (RPD)

The RPD hears and decides refugee protection claims made in Canada. It assesses whether the claimant meets the requirements for refugee protection.

Refugee Appeal Division (RAD)

The RAD considers eligible appeals of RPD decisions allowing or rejecting refugee claims. Not every RPD decision can be appealed to the RAD.

Immigration Division (ID)

The ID conducts admissibility hearings and reviews immigration detention. These proceedings concern whether a person may enter or remain in Canada, or should continue to be detained.

Immigration Appeal Division (IAD)

The IAD hears certain immigration appeals, including eligible family sponsorship refusals, removal orders and permanent resident residency obligation decisions. Appeal rights depend on the decision and the circumstances.
